GCNKAA Files Suit to Support Members

The Greater Cincinnati Greater Cincinnati Northern Kentucky Apartment Assocation (GCNKAA) and three Northern Kentucky apartment building owners’ have filed suit against Kentucky Gov. Andy Beshear, challenging his orders that are basically halting evictions in Kentucky.

The lawsuit was filed in May in the U.S. District Court for the Eastern District of Kentucky in Covington by Crestview Hills attorney Chris Wiest. Plaintiffs are asking the court to declare the Governor’s No Eviction Order unconstitutional and halt enforcement of the orders.

While some tenants are clearly and legitimately continuing to experience financial difficulty and unable to pay rent because of the pandemic, others are taking advantage of the Governor’s orders by not paying their rent.

The GCNKAA and its landlord members have established a tenant assistance fund to help tenants who are unable to pay rent. In addition, the Association has established relationships with community organizations to help tenants find jobs and rent assistance and has strongly encouraged both landlords and tenants to work together to reach payment agreements.

But clearly, some tenants have abused the system and the situation, leaving their landlords with costly bills for maintenance, utilities and other expenses.

Even the Governor has frequently acknowledged that the pandemic in Kentucky is winding down and every adult who has sought a vaccine has had the opportunity to receive one. Yet his orders continue to punish Kentucky’s property owners and inhibit their rights.
